We Mean It-Man!
O.k., am I boring you yet? You know,
with the constant going on about you and your copy rights. Boring at times yes, but very important things we all
need to know. Well prepare yourself because here comes the latest version of "the nation's top cop"
- U.S. Attorney General John Ashcroft, and if you break any copyright laws, rest assured he's gonna' get you- literally-
no joke about it! The music industry, movie studios and retailers want prosecution to the fullest extent of the law and in
Atty. General John Ashcroft they're singin', "ain't it good to know- I've got a friend."
Last week the Atty. General, along with
the U.S. Department of Justice announced a plan to broaden and introduce new prosicutorial power on intellectual
property crimes and piracy, including of music and movies.
Unveiling a 100 page report, the department's
Intellectual Property Task Force presented a long list of proposals for beefing up the anti-piracy enforcement laws, giving
federal prosecutors more power to pursue those everyday infringements.
Holding a news conference here in our Los
Angeles, U.S. Atty. General John Ashcroft said the Dep. of Justice would immediately implement the organizational
changes included in the task force's 55 page proposals.
Wow, a task force yet-and in L.A.!
Ashcroft said he will seek the proposed
legislative changes when the new Congress convenes in January.
Of course the music and movie industries
praised the new initiative, so did VSDA retail groups. "VSDA applauds the Task Force's recognition that video piracy and other
forms of intellectual property theft are a growing problem that has global implications and also real world consequences for
consumers," VSDA president Bo Andersen stated.
Global implications-sounds kinda' like
a nuc bomb exploding, or global warming, doesn't it? But we are talking $$$ here peeps, guess now $
has gone global!
Among the many changes to the current enforcement
efforts, the department will expand the number of special units dedicated to combating intellectual property theft, which
are centrally located inside U.S. attorney offices across America.
As you read on, Computer Hacking and Intellectual
Property Units are operating in 13 cities, with offices to be set up in 5 new states. Existing offices here in L.A. and San Jose
will be beefed up to deal with its "hotbed of intellectual property theft."
Hmm, San Jose, a hotbed
of intellectual theft -who knew?
Joining their foreign counterpart in international
trafficking infiltration, the F.B.I. will place federal prosecutors with expertise in intellectual property at U.S. embassies
in Hong Kong, Budapest and Hungary. The report notes that economic development in Asia has increased piracy by boosting manufacturing
capacity, resulting in more counterfeit product on U.S. shelves. And John Ashcroft doesn't like that-or you!
Yes, you-if
you dare purchase, take, or participate in any form of intellectual property theft of any kind! Ashcroft would like the Congress
to criminalize the possession of counterfeit and swapped goods rather than just the distribution, which would make
prosecution so much easier.
But wait-Ashcroft also wants to give prosecutors
authority to use wiretaps and other techniques typically used in white-collar and organized crime crackdowns, and he is confident
the Justice will join the industry groups in obtaining prosecution.
"It's going to take people outside of government
to both help us prepare cases and to report cases, and to educate the public. We don't think this is something that can just
be regulated to the federal government," says John.
By one means or another, controversy continues
to cling to entertainment. Oh the politics of creativity and having fun. Yes, and "the politics of dancing."

Speak Up For Yourself - If You Don't, Who Will?
-The Good, Bad, and the Ugly-
I hope you voted, as if your rights depended
on it, because they do. Before the 108th
Congress in Washington headed home for the election last week, a so close and yet so very far haggling session took place. Supporters of the several major anti-piracy measures on Capitol
Hill nearly managed to get their bills to the floor of the House or Senate for a vote.
It's all about convincing the people in
charge and sadly, those measures most highly prized by the entertainment industry came up a little short.
Although Congress is expected to return
briefly after the election, it usually deals with appropriations bills and must-pass legislation.
In practical terminology, the Inducing
Infringement of Copyright Act, the Piracy Deterrence and Education Act, and the Protecting Intellectual Property Against Theft
and Expropriation Act - the last two containing provisions banning the use of camcorders in theaters - bit the dust and died
last week with this particular Congress.
That means in order to become law, they
will have to be re-introduced in the 109th Congress which convenes next year, and go through the whole process again!
Whew, that's a lot of talk!
The odds of the 109th Congress ruling in
their favor somewhat depends on how the election turns out. Although copyright issues are out of the traditional party norm,
legislation is held captive to the congressional committee system. Committee chairs have leverage over which bills are
considered, and votes on which bills get sent to the floor for action by the full House or Senate.
Should the Democrats gain control
over the House or Senate, there would be a complete turnover of committee chairmanships. Although the major anti-piracy bills
have bi-partisan sponsors, the new committee chairs may not consider them priority, thus pushing the piracy bills back to
the legislative line.
Now for the bonus track-
Senator Hatch, remember him? The author of the Induce Act is getting the
boot! The Senate Judiciary Committee will appoint a new chairman next year, even if the Republicans retain control. Under
the Senate term-limits, Orrin Hatch must relinquish his gavel at the end of the 108th Congress.
With pure fury before stepping down, Orrin attempted
to strong-arm supporters and opponents of his Induce Act into a compromise that would allow the bill to go forward! What
a bully! After locking the parties in a room for a week of round the clock negotiations to no avail, Orrin called it
quits, the measure never coming up for a vote again.
The failing of Orrin's Induce Act was a
double A kick for the major labels and studios. Not only do they have to start all over next year but
the uncertain outcome could persuade the Supreme Court to turn down their appeal of the Grokster case, while it waits
to see what Congress does.
The Induce Act would effectively overturn
the Ninth Circuit's decision in Grokster by legislation. Faced with the possibility of having its judgement rendered moot,
the Supreme Court might just decide to pass on it for now. Ouch, because that would leave the labels and studios, for now
at least, with no bill and a negative court ruling on the books!
The Induce Act is a high legislative priority
for many, with many lobbying heavy for its passage. Despite the bill's failure- a silver lining: "Our efforts in this area
were recognized during House debate on the Piracy Deterrence and Education Act," says VSDA president Bo Andersen.
Whether bein' reco'nized will have
any meaningful legislative action on piracy must await the election results, along with the convening of the 109th Congress.

don't either, but it's being released on DVD, Jan. 4, with snappy titles such as " Dance Your Cares Away, not to mention those

So have you checked out the singing,
songwriting, The Inducing Copyright Infringement Act of 2004 creator and drafter, Senator
Orrin Hatch yet? Well here's the latest blabla on the Induce Act copyright ruling controversy, and how it's affecting you
at this very moment:
On August 19, a federal appeals court ruled
that file-sharing networks such as Grokster and Morpheus cannot be held liable for copyright infringement committed by their
users. The Ninth Circuit Court of Appeals ruling upholds an earlier lower-court decision, which dealt that Kapow
blow to the studio and record company attempts to kill peer to peer technology.
According to Judge Sidney Thomas, we "live
in a quicksilver technological environment with courts ill-suited to fix the flow of internet innovation, the introduction
of the new technology is always disruptive to old markets and particularly to those copyright owners whose works are sold
through well established distribution mechanisms. Yet history has shown that time and market forces often provide equilibrium
in balancing interests."

Judge Sidney adds, "it is prudent for courts
to exercise caution before restructuring liability theories for the purpose of addressing specific market abuses, despite
their apparent magnitude." gatta love the guy!
Handed down last year, the lower court
ruling had been the first major peer to peer case to go against the studios. Appealing that decision, studios and record companies
hoped to restore their clean record and maintain the legal grip against unauthorized online file sharing.
By ruling against copyright owners, the
appeals court has guaranteed that the controversy continues. In the Aimster and Napster cases, the federal courts ruled peer
to peer networks were liable, ordering them to shut down unless they could filter infringing files from their systems. Those
earlier systems relied on more centralized network control than Grokster and StreamCast, a point underscored by the court.
The court claims Grokster and StreamCast
architecture made them more like VCRs, which are protected under the Supreme Court's 1984 Sony vs Universal ruling. Although
the studios and record companies have a right to appeal the Ninth Circuit's ruling to the U.S. Supreme Court, more than likely
they will head back to Capitol Hill in an effort to get Congress to clarify standards for secondary liability in cases of
copyright infringement.
"In Sony-Betamax, the court spoke quite
clearly about the role of Congress in applying copyright law to new technologies," Judge Sidney states. So

only hope for congressional action lies in last week's bass subject, Senate Judiciary Committee chairman Orrin Hatch. His

including the bill's die hard opponents who, unable to prevent it, hope to narrow its scope for the better.
So who is Orrin Hatch, and what 'up with his bill?
Orrin is a singing, songwriting Senator with a few CD's to his credit, he
created the bill in response to a federal court ruling earlier this year favoring peer to peer network giants Grokster and
Morpheus.

Citing the 1984 Supreme Court
Betamax ruling, the court stated the companies maintaining the networks
could not be held liable for the infringing activity of their users. That meant a K'POW
blow to the legal strategies of the studios and record companies, which had succeeded so well in shutting down Napster and
Aimstar on grounds of knowingly contributing to infringement.
But wait, Orrin's Induce Act holds liable anyone who "intentionally aids,
abets, induces or procures" copyright infringement by others.
Hatch Takes Aim at Illegal Downloading... how legitimate rediculous laws like the ones Orrin obviously abides ... Hatch
and the RIAA cronies would love nothing more ... for you to buy music (on CD's that have ... tim.movementarian.com/archives/000226.html - 12k -
That means it not only closes that legal 1984 loophole of escape, it effectively
overturns the Supreme Court's ruling in Betamax, which for the last 20 years has formed the foundation of the copyright policy
in the U.S.
"Third parties should not be held legally liable for the criminal acts
of others solely to appease Hollywood millionaires and their trial attorney friends," the American Conservative Union
states.
"This misguided legislation would hold manufacturers of computers
and software criminally liable if their legal products were misused to reproduce copyrighted material."
And just how far the Induce law will reach is the main concern being
hammered out in those Senate Judiciary Committee negotiations.
VSDA president Bo Anderson endorses the Induce act as it is, casting the
blame on P2P networks for encouraging a "culture of lawlessness" built on the "plain theft" of music and the movies.
VSDA (video software & dealers association) has joined both the
studios and record companies in lobbying those lawmakers on its behalf.
But even closing the loophole, the bill represents a drastic departure from
established approaches to copyright in that it takes the law into uncharted territory, with potentially far reaching implications!
Not only does it affect the studios' ability to control online piracy, it
will hold significant implications in the future for everyone from entertainment to computer technologies, which could severely
limit technological innovation.
In various countries today there exists such a thing as the Television Tax;
you must pay to have and watch TV. But isn't that just like our cable TV? And when you include the electricity you pay to
run the radio, CD, and computer, our music and entertainment is surely not free! Not to mention those high CD prices!
We are graced with eyes and ears, courtesy of life. Leave it to the
legal system to make it a crime to see and hear certain things for free! What else? What about pay toilets and metered parking?
And we can't receive something for free and give it to someone else? And we can't record or burn something and give
it away? What's next, big brother cameras monitoring every household?
If we can't do it, could they please PRINT the violations
a little larger so everyone reads and understands the very fine print! Or at the very least, how about a monthly rules and regulations newsletter so we know exactly which laws we
continue to break daily!
Oh but wait, that knowledge is our responsibility to know. So
much for ignorance being bliss. Today if you don't know you are breaking the law, it's a crime punishable to the highest extent
of the law!
So much for the Constitutional right to our pursuit of happiness...

We lost Rodney Dangerfield on October

in the morning.

film projects dealing with the dangers of nuclear power -one produced by Douglass, the other by Jane
