DEMUR - Black's 3rd

To present a demurrer; to take an exception to the sufficiency in point of law of a pleading or state of facts alleged. See Demurrer.

DEMURRER - Black's 3rd

The formal mode of disputing the sufficiency in law of the pleading of the other side. In effect it is an allegation that, even if the facts as stated in the pleading to which objection is taken be true, yet their legal consequences are not such as to put the dumuring party to the necessity of answering them or proceeding further with the cause. * * *

Some say that Adam lost title of the earth to Satan when he sinned in the garden of Oden, but the Bible clearly states that God has title to the Earth:

Exodus 19:5 Now therefore, if ye will obey my voice indeed, and keep my covenant, then ye shall be a peculiar treasure unto me above all people: for all the earth is mine:
Joshua 3:11 Behold, the ark of the covenant of the Lord of all the earth passeth over before you into Jordan.
Psalms 22:27 All the ends of the world shall remember and turn unto the LORD: and all the kindreds of the nations shall worship before thee. 28* For the kingdom is the LORD'S: and he is the governor among the nations.
Psalms 47:9* The princes of the people are gathered together, even the people of the God of Abraham: for the shields of the earth belong unto God: he is greatly exalted.
Psalms 50:12 If I were hungry, I would not tell thee: for the world is mine, and the fulness thereof.
Psalms 97:5* The hills melted like wax at the presence of the LORD, at the presence of the Lord of the whole earth.
Micah 4:13* Arise and thresh, O daughter of Zion: for I will make thine horn iron, and I will make thy hoofs brass: and thou shalt beat in pieces many people: and I will consecrate their gain unto the LORD, and their substance unto the Lord of the whole earth.
Zechariah 4:14* Then said he, These are the two anointed ones, that stand by the Lord of the whole earth.
Zechariah 6:5 And the angel answered and said unto me, These are the four spirits of the heavens, which go forth from standing before the Lord of all the earth.

As recorded in Daniel 4 and 5, King Nebuchadnezzar declared the Lord God had dominion over the kingdoms of men:

Daniel 4:
34 ¶ And at the end of the days I Nebuchadnezzar lifted up mine eyes unto heaven, and mine understanding returned unto me, and I blessed the most High, and I praised and honoured him that liveth for ever, whose dominion is an everlasting dominion, and his kingdom is from generation to generation:
35* And all the inhabitants of the earth are reputed as nothing: and he doeth according to his will in the army of heaven, and among the inhabitants of the earth: and none can stay his hand, or say unto him, What doest thou?
37 Now I Nebuchadnezzar praise and extol and honour the King of heaven, all whose works are truth, and his ways judgment: and those that walk in pride he is able to abase.
Dan 5:
21* And he was driven from the sons of men; and his heart was made like the beasts, and his dwelling was with the wild asses: they fed him with grass like oxen, and his body was wet with the dew of heaven; till he knew that the most high God ruled in the kingdom of men, and that he appointeth over it whomsoever he will.

And as recorded in Daniel 6, after seeing Daniel survive the lion’s den, King Darius made a decree:

Daniel 6:
26* I make a decree, That in every dominion of my kingdom men tremble and fear before the God of Daniel: for he is the living God, and stedfast for ever, and his kingdom that which shall not be destroyed, and his dominion shall be even unto the end.

So it is established that God owns and rules over the Earth.

Jesus was tempted by Satan wherein Satan claims* ownership of the kingdoms of the Earth, asking Jesus to worship him:
(*Actually, Satan does not exactly claim he owns anything, but makes a statement by which we might infer that he does.)

Matthew 4:
8* Again, the devil taketh him up into an exceeding high mountain, and sheweth him all the kingdoms of the world, and the glory of them;
9* And saith unto him, All these things will I give thee, if thou wilt fall down and worship me.
10* Then saith Jesus unto him, Get thee hence, Satan: for it is written, Thou shalt worship the Lord thy God, and him only shalt thou serve.

Jesus does not at that point deny Satan’s claim of ownership but simply rebukes him in the form of a demur. Why? It is because to have answered Satan’s false claim would have been a traverse. Jesus, being perfect, had to go to the core issue, that even if Satan did own something, He must never worship any One other than God.

There’s a joke about a older rich man meeting an attractive young woman at a party. He asks her if she would sleep with him for a million dollars. She thinks about it and responds that she would. He then asks if she would sleep with him for a hundred dollars. She becomes incensed and asks “What kind of woman do you think I am?” To which he replies, “We’ve established what kind of woman you are, we’re just haggling over price.”

What if Satan approached a married person and offered some inducement to be unfaithful to his or her mate? One hundred dollars. No? One million dollars. No? The kingdoms of the world. You say you don’t believe he can make his offer good? But what if he could?

If Jesus had responded by saying that Satan didn’t own the kingdoms he claimed, Satan could have said that if he had, Jesus would have worshipped him as that was his first objection. Jesus had to answer that no matter the inducement, His heart was true to His God and He would never worship any other. Who says that temptation must only come as a challenge to morals? Satan challenged Jesus' wit and Jesus, being most excellent, won. (Would you have His intent be questioned, even if by Satan?)

Later on, Jesus indirectly asserts that God is Lord over the whole earth, countering the previous claim by Satan:

Matthew 11:25* At that time Jesus answered and said, I thank thee, O Father, Lord of heaven and earth, because thou hast hid these things from the wise and prudent, and hast revealed them unto babes.
Luke 10:21* In that hour Jesus rejoiced in spirit, and said, I thank thee, O Father, Lord of heaven and earth, that thou hast hid these things from the wise and prudent, and hast revealed them unto babes: even so, Father; for so it seemed good in thy sight.

Also, Stephen quotes the Old Testament reasserting this truth:

Acts 7:49 Heaven is my throne, and earth is my footstool: what house will ye build me? saith the Lord: or what is the place of my rest?

Likewise Paul:

1 Corinthians 10:26 For the earth is the Lord's, and the fulness thereof.
1 Corinthians 10:28* But if any man say unto you, This is offered in sacrifice unto idols, eat not for his sake that shewed it, and for conscience sake: for the earth is the Lord's, and the fulness thereof:

So if Satan rules or owns anything, what is it? (Satan's statement recorded in Matthew 4:8-9 is now seen as the effrontery of trying to sell things he does not own or control to their rightful owner; but this was only an attempt to cover his assault on Jesus Christ's character, and indeed, if it were possible, even to cause Him to give up everything He had or would ultimately receive by becoming Satan's slave. But Jesus was not fooled. And don't be surprised that Satan made a sham offer - he is a liar and the father of it.)

Jesus Christ reigns, but apparently there are realms into which He does not usually enter.

1 Corinthians 15:
22* For as in Adam all die, even so in Christ shall all be made alive.
23* But every man in his own order: Christ the firstfruits; afterward they that are Christ's at his coming.
24* Then cometh the end, when he shall have delivered up the kingdom to God, even the Father; when he shall have put down all rule and all authority and power.
25* For he must reign, till he hath put all enemies under his feet.
26* The last enemy that shall be destroyed is death.
27* For he hath put all things under his feet. But when he saith all things are put under him, it is manifest that he is excepted, which did put all things under him.
28* And when all things shall be subdued unto him, then shall the Son also himself be subject unto him that put all things under him, that God may be all in all.
