END-USER LICENSE AGREEMENT FOR PRE-RELEASE SOFTWARE

IMPORTANT-READ CAREFULLY: This End-User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and Dr. Tyler C. Folsom for the software product identified above, which includes computer software and may include associated media, printed materials, and "online" or electronic documentation ("SOFTWARE PRODUCT"). By signing this document, you agree to be bound by the terms of this EULA.
SOFTWARE PRODUCT LICENSE
The SOFTWARE PRODUCT is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The SOFTWARE PRODUCT is licensed, not sold.
1. GRANT OF LICENSE. This EULA grants you the following limited, non-exclusive rights:
a. Basic Grant. You may install and use the SOFTWARE PRODUCT on one computer for the sole purpose of designing, developing, and testing applications.
b. Additional License Rights. In addition to the rights granted in Section 1(a), Dr. Folsom grants you the right to modify the source code version of the SOFTWARE PRODUCT (your "Source Modifications). You agree to make all such modifications available if requested by Dr. Folsom. Source Modifications may be incorporated into future releases of the SOFTWARE PRODUCT with no compensation to you.
c. Reserved Rights. Your right to modify the SOFTWARE PRODUCT is subject to Dr. Folsom's reservation of rights in any and all intellectual property rights not embodied in the SOFTWARE PRODUCT. Dr. Folsom retains title and all ownership rights to the SOFTWARE PRODUCT. All rights not expressly granted are reserved to Dr. Folsom.
2. COPYRIGHT. All rights, title, and copyrights in and to the SOFTWARE PRODUCT (including, but not limited to, any images, photographs, and text incorporated into the SOFTWARE PRODUCT) and any copies of the SOFTWARE PRODUCT are owned by Dr. Folsom. The SOFTWARE PRODUCT is protected by copyright laws and international treaty provisions. Therefore, you must treat the SOFTWARE PRODUCT like any other copyrighted material.
3. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.
a. Termination. Without prejudice to any other rights, Dr. Folsom may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the SOFTWARE PRODUCT and all of its component parts.
b. Non commercial use. Use of the SOFTWARE PRODUCT is limited to educational and research purposes.
c. Not For Resale Software. You may not sell, resell, or otherwise transfer for value, the SOFTWARE PRODUCT.
d. Rental. You may not rent, lease or lend the SOFTWARE PRODUCT.
4. PRODUCT ("Support Services"). Support Service is limited and may be unavailable. Any supplemental software code provided to you as part of the Support Services shall be considered part of the SOFTWARE PRODUCT and subject to the terms and conditions of this EULA. With respect to technical information you provide to Dr. Folsom as part of the Support Services, Dr. Folsom may use such information for his business purposes, including for product support and development.
5. EXPORT RESTRICTIONS. You agree that you will not export
or re-export the SOFTWARE PRODUCT, any part thereof, or any process or service
that is the direct product of the SOFTWARE PRODUCT (the foregoing collectively
referred to as the "Restricted Components"), to any country, person,
entity or end user subject to U.S. export restrictions. You specifically agree not to export or
re-export any of the Restricted Components (i) to any country to which the U.S.
has embargoed or restricted the export of goods or services, which currently
include, but are not necessarily limited to Cuba, Iran, Iraq, Libya, North
Korea, Sudan and Syria, or to any national of any such country, wherever
located, who intends to transmit or transport the Restricted Components back to
such country; (ii) to any end-user who you know or have reason to know will
utilize the Restricted Components in the design, development or production of
nuclear, chemical or biological weapons; or (iii) to any end-user who has been
prohibited from participating in U.S. export transactions by any federal agency
of the U.S. government. You warrant and

NO WARRANTIES. Dr. Folsom expressly disclaims any warranty for the SOFTWARE PRODUCT or related Support Services (if any). TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE PRODUCT AND ANY RELATED DOCUMENTATION IS PROVIDED "AS IS" WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT. THE ENTIRE RISK ARISING OUT OF USE OR PERFORMANCE OF THE SOFTWARE PRODUCT REMAINS WITH YOU.
LIMITATION OF LIABILITY. Dr. Folsom's entire liability and your exclusive remedy under this EULA shall not exceed five dollars (US$5.00).
NO LIABILITY FOR DAMAGES. To the maximum extent permitted by applicable law, in no event shall Dr. Folsom or his associates be liable for any damages whatsoever (including, without limitation, damages for loss of business profit, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of, or inability to use, this product, even if Dr. Folsom has been advised of the possibility of such damages. Because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.
