This Lease made by and between Tenant:__                      ____ with mailing address of :__                                ____       and Landlord John Inglesby.  The above mentioned Landlord hereby leases to the undersigned Tenant, and the Tenant hereby leases from Landlord, property located at:  56 Atlantic Avenue, Bethany Beach DE

A 5 Bedroom + Den, 4 Bath, 2 Outside Shower, Single Family Home from 2:00PM on the         day of             , 2008 to 10:00AM on the     of              , 2008 to be used solely as a private dwelling for the use of the Tenant, her family and guests and not for what is known as a “group rental”.

1.             Tenant agrees to pay Landlord, as rent for the above period the following sums:                 $                          

                Plus Tax:                                                                                                                                 $     6%.     

                Plus Security Deposit.  If no damages, deposit is returned within 14 days after departure  $500.00  

                For a total amount of:                                                                                                             $

Payable as follows: 50% due upon execution of the lease, the receipt of which the landlord hereby acknowledges, and the remainder due 30 days prior to rental.

 

2.                    It is agreed that Landlord or their employees for the purpose of clean up and repair may enter the premises at 10:00 A.M. on the date the lease terminates and may remain on the premises until 6:30 P.M. on the day that the lease commences.   Tenant agrees to surrender possession of the property hereby leased at the expiration of this lease, peaceably, and without delay, in as good condition as it was at the commencement of this lease, reasonable wear and tear excepted.

3.                    If the Tenant fails to commence the tenancy, the deposit or any installment paid before the tenancy shall be retained by the Landlord as liquidated damages and the Tenant shall be relieved of further payment of the lease.  If, in the case of a cancellation, Landlord is able to re-rent the property, Tenant who is canceling shall pay Landlords costs to re-rent.  These costs may include newspaper advertisements and/or Agent 15% commission for securing a new Lessee.  Such costs will be deducted from deposit and balance returned to original Lessee.

4.                    This Lease shall only be legally effective after Tenant has returned the original together with the required deposit within 5 days after date of mailing.

TENANTS MUST PLACE ALL LONG DISTANCE CALLS ON CREDIT CARDS OR REVERSE CHARGES.  Tenants cannot charge long distance calls on Landlord’s phone.

6.                    Tenant to furnish all LINENS, BLANKETS, TOWELS AND PAPER PRODUCTS.

7.                    Two standard television sets, 1 27” HDTV, Cable TV (No premium channels are available), two VCRs, 1 DVD, Stereo, and CD player are provided.  Music CDs and VCR movies are provided for your enjoyment.  These must be left in the unit upon exit.

8.                    Beds:       2 Singles, 4 Queen, 1 Double Sofa bed

9.                    Appliances include: Refrigerator with icemaker, second “Kids” refrigerator located in Den, Garbage Disposal Coffee Maker, Toaster, Microwave, Ceramic Flat Surface Cooktop, Blender, Dishwasher, 2 sets of Washer &  Dryers, 10 Ceiling Fans, 2 Zone Central Air, 2 Hot Water Heaters.

10.                 Tenants are requested to water flowers, plants, and gardens during occupancy.

11.                 NO SUBLETTING WILL BE PERMITTED.  Tenants will be in violation of the lease if subletting occurs and Landlord may ask Tenant to VACATE the premises.

12.                 NO PETS OF ANY KIND WILL BE PERMITTED.  Tenants found with pets will be in violation of this lease.  Immediate eviction and additional charge of $250 will be imposed if a pet is found on the premises.

13.                 Icemaker and garbage disposal are not guaranteed. 

14.                 The premises are to be occupied by no more than 12 people.

15.                 Keys will be mailed to Tenants prior to lease.  If keys are lost or misplaced during lease, EMERGENCY KEYS can be secured locally.  All Keys must be returned to to the landlord upon vacating the property.

16.                 We cannot mail back items left in the house.  Arrangements must be made to have them picked up.

17.                 If the Tenant, family members, or guests create any disturbance to the peace which is reported to the Landlord or Police, or violates any of the terms of this lease, the tenant at the sole discretion and request of the Landlord agrees to vacate the premises immediately upon said request of the landlord.  In this event, the Landlord agrees to make every effort to re-rent the premises, and if  successful in this endeavor, to refund to the Tenant that portion of their rent that was paid for the period vacated less unusual costs of repair or clean up.

18.                 Tenant is not responsible for electricity however it is expected that it be used in a prudent manner.  If Air Conditioning is used, all doors and windows must be closed.  Landlord is responsible for all other utilities unless otherwise indicated.

The master suite includes sitting area, fireplace (fall use only), two level ocean deck with spiral stairway, fully mirrored bath with private deck, his and hers sink, dressing vanity for her, oversized soaking tub, steam room shower, and walk in closet.

 

The other two upper level bedrooms are of generous proportion.  One has an Ocean view deck and they share a pass-thru bath, each with private sink.

 

There are two main level bedrooms, one with private dressing area and full bath.
