June 15th, 2003. I have taken John Martin of Albemarle Co., VA off of this page. I still believe that he was related in some way other than through his wife's family, but I no longer believe that he was a son of Benjamin Martin, Sr..

I have also taken out the descendants of William Martin. We know that one line I had was not correct, and are not sure about any other "facts" I had on William. I would like very much to find proven descendants willing to join us in our Martin DNA Project and male Martin's who descend from the Brunswick Co., VA Martin's and the NC Martin's in hopes that DNA will show which of these families are related and which are not. Inventory of Benjamin Martin was returned into court 24 Jul 1766, Orange Co., VA..
There was no will. Inventory does not name children.

From Cindy Conser: I think Benjamin and Elizabeth were already
married when he appeared in court for her to settle the estate.
This occurred
7 Mar 1737/8, which was more than three years
later. The court order doesn't mention
Elizabeth's name. It
says: 'On the motion of Benjamin Martin to have the Estate of
Richard Blanton deced appraised is granted...' This is
accordance with the will, which said that if Elizabeth
remarried, then the estate was to be appraised (in order to
protect the interests of Richard's heirs). I think this is the
best indication we may ever have of Benjamin & Elizabeth's
wedding date -- probably happened just before this court order.

Cindy Conser: 'Another interesting find was the 1820 census,
which showed Henry Martin in
Orange County on page 72: 1 free
white male over age 45 and 1 female slave over age 45, no
others listed in household. I didn't look at the Culpeper
census schedule, but according to an index to the 1820 VA
census, the only Martins heads of household in that county
were: Francis, James, Thomas and William.'

Sold land in Spotsylvania Co., VA on this date to George
ATKINSON. Deed says Benj. and Sarah were 'of Orange Co., VA'.
Proven in Aug court 1821. 90 acres.

 

Cindy Conser found evidence that Benjamin Martin was still in
Orange
County in 1785. Found a state census showing him with 6
'white souls', 2 dwellings and 3 other buildings. (Maybe some
of the boys had gone to KY or were living/working in some other
household already?) Henry Martin was listed with 5 'white
souls', 1 dwelling and 4 other buildings. There was also an Ann
Martin in another part of the county with 1 'white soul,' 1
dwelling and 4 other buildings. Source: Heads of Families at

I think I found why slave Peggy might have been called Lewis...See 1850 census Peggy Lewis age 100, black,
b VA living w/ Stephen Walter.

Dece'd being submitted In Court it Appears to this Court that

John Martin an Infant the son of John Martin Dece'd is under

the Age prescribed by Law to appear before This Court an heir

at Law to the Dece'd to show Cause why this will Should not be

proved And Edmond Waller being on this Occasion appointed His

Guardian who Answered that he had no objection to offer against

the Probate thereof in this Orphans behalf Then this Will was

Proved by The Oaths of Martin True and Robert True, two of the

Witnesses thereto And Jane Martin Benjamin Martin and Martin

True the Exectors Therein named have Given bond and Taken the

Oath in the Law Direct Certification in D___ form of Law is

Granted them for obtaining Letters of Probate. And it is

Ordered that Edward Herndon Thomas Hayden Wm Proctor and

Charles Steward Senr or any three of them to Appraise all the

Estate of the said Dece'd as Shall be shown them by the

Executors [they being first Sworn before Some Majestrate of

this County] and return their proceedings to the Next Court.'

town of Louisville in 1790.

Petition No. 58: Request of the inhabitants of the District of

Kentucky for a repeal of the Act of Separation, dated 29

October 1789. There were actually three petitions on this date.

One of them contains the signatures of Joseph Davis (1st

signature), James Blanton, Thomas Blanton, Ambrose Gordon,

Edmund Talbot, Benj. Davis, James Davis, Thomas Davis, Abner

Martin, William Gordon, Alex. McClure, John M'Lure, Benj.

Martin, Lindsey Martin, Rubin Martin, William McMurtry and

Linza Martin, among many others I'm sure you'll recognize.

Then there should have been a paper with that which read" July court 1841,

Reuben cooley, one of the devisees named in a writing purporting to be the

last will and testament of Elizabeth Martin dec'd this day presented said

writing for probate. Whereupoon Larkin Martin, Benjamin Walters, and David

Walters by their counsel appeared objected to the probate thereof, and upon

affidavit sworn to _____(can't make out that word.) moved the court to

continue this case until the next term which is granted. "<<

Futrell for and on behalf of the defendants to the north half of the Southeast Quarter of Section 1, Township 2 Range 4 East, containing 80 acres more or less lying in Calloway County, to correct an error made in describing the land named in the deed made by A.Bowerman from us the Master Commissioner of said court to the Plaintiff Winburn Futrell. NOW THEREFORE, this Indenture made and entered into this 26th day of April, 1877 between the defandants, they being hiers of James Martin, deceased, part of the first part and the said John A. Futrell, party of the second part. Witnesseth: That for and in consideration of the premises and by virtue of the pwoer and authority in me, P.M.Ellison, Special Commissioner, vested by the judgement of said court does hereby, for and on behalf of said party of the first part grant and convey to the said John H. Futrell, his heirs and assigns foever, the land hereinbefore described, to wit: The north half of the southeast quarter of Section 1, Township 2, Range 4 East, containing 80 acres more or less. Apparently, an error was made in an earlier suit by whoever the Master Commissioner may have been at that time, in his description of the land. Apparently, too, they had to go back into court to settle it. Normally, these things were just corrected by a re-recording of the old deed, with some language explaining why it was being done, and with the correction of the land description noted.

Notes on Baker Martin

He was living in Lafayette County, MO. 11 Dec 1833. Land deeds show that he owned over 100 acres of land in the place that is now Wellington, Lafayette County, MO. on the Missouri River. Will names all children... Shows that he was a wealthy man.

Baker owned the land where the Martin-Carr cemetery still can be found (April 4th, 1995). It is possible that he, his wife, and his Father are all buried in that cemetery, but at this time the stones can no longer be found.

He was 16-20 on the 1810 census, isn't found on the 1820, then is 40-50 on the 1830 and had died by the 1840.

Evelyn Phillips Breisford, 107 Legion Drive, Princeton, KY sent me this in April 1979

She was the dau. of Dr. James Rufus Phillips, who lived all his life in Calloway Co. He mar. Belinda E. Hood. In this letter... E. sd he died of scarlet fever. She also sd "Your old grandmother Martin [Priscilla Davis] is still improving though she minds very slow she was not able to come up here at all while Thomas was sick the negros down there are not not intirely well of the scarlet fever yet. Jane [her sister] is not well and it is doubtful whether she ever will be sound again. Hellen I send to you in this letter a lock of little Tommy hair. my mind is very much confused and scattering so I shall add nothing more in this But ever Remain your affectionate mother until death."

'Shot and killed by guerrillas... I can remember Walter telling the story many times. They had been to his house, where his 2
sisters lived with them & taken a lot of things to eat. 1 sister had hidden a bolt of blue jean cloth and one man found
it and was trying to take it from
Wilson's wife and sister, when he took a hatchit and hurt or killed one man the other got
away and went back to camp to get help about 1/2 mile... Wilson and one son tried to get to
Campbell's for help only getting as far as the spring (about 1/2 the way). They killed Wilson and wounded his son, then rode back to Martin's telling his wife
her husband was at the spring and wanted a drink. She found him sitting against a tree, dead.' [Joan Martin Clark, 12 May 1981]
