Facing off with Children’s Protective Services!

 

 Unfortunately another part of raising a handicapped child has become dealing with Government officials, and or agencies, and it is sadly apparent that a lot of these contacts lead to investigations and or removal of the special angels that the government is asked to protect and help.

Many families have had the sad misfortune of having CPS enter their lives for one reason or another, and they are then put under a microscope and examined for any minute flaw that could be misconstrued to make the parent look unfit. Afterwards the child is removed from the family and placed either into foster care or institutions where they are left to face the nightmare of their handicap without even the support of their own family!

We must do all we can to stop this outrage in our country! And we must  learn all we can to protect our children!

Before going on to explore other websites that offer help dealing with Children’s Protective Services I want you to keep these important instructions in mind.

 

1.       When and if contacted by CPS about  your child you must know your rights, including your Miranda rights and adhere to them to the letter! If possible keep a copy of your Miranda rights close to your door for easy access if and when anyone appears at your door and insist that they respect your civil rights!

2.       Insist on your right to have an attorney present during questioning! You will probably be told that this is unnecessary but insist on it anyway and never answer questions without either an attorney present or enough knowledge of the laws to know how to protect yourself!

3.       Keep good records! Document every encounter with CPS, as well as your account of what happened during that encounter, follow up each encounter with a letter to the caseworker telling her what you believe the events of the meeting were, keeping a copy for your own records.

4.       Never sign away permission for CPS to discuss your case or your family with others! If it is absolutely necessary for CPS to have contact with other agencies such as psychiatrists, therapists, doctors etc. make sure that you give them only limited permission for one time only describing exactly what is allowed to be revealed, and nothing more! Insist that your right to privacy be adhered to!

5.       If the laws in your state allow it record all encounters with CPS either with an audio recorder or preferably with a video recorder.

6.       Put up no trespassing signs around your property immediately, don’t wait for an encounter with CPS! Do this now! No Trespassing signs are a very useful tool when used in conjunction with a phone and the local 911 service, use it! If you have a worker showing up without prior permission or a search warrant then you have every right to have them removed from your property!

7.       Invest in an answering machine with recording capabilities and caller ID if you don’t have them, this will help a lot in the long run for screening calls, record keeping, as well as recording conversations over the phone.

By now you’re probably saying to yourself surely there’s no call to go to these extremes, and I’m sure that if a CPS worker were standing at your door they’d assure you that I am wrong, that you need to cooperate, and they may even tell you that your refusal to cooperate only makes you look guilty, but trust me when I say that anything you may say can make you look guilty! A simple comment or statement that you make can be misconstrued to harm you and your family, and that is not an acceptable chance to take! When in doubt silence is the best way out!
