Quite often rental properties go into foreclosure. One question that commonly arises is
whether tenants must continue to pay rent if the landlord is in foreclosure.
The answer is quite clear that unless directed by the court to pay funds into the registry of
the court the tenant’s obligation remains with the landlord. Payments must continue to be made and maintained
current at all times or the tenant is subject to eviction.
Tenants cannot resort to self help. In many instances, the foreclosure may be dismissed
or brought current or the property can be conveyed subject to a lease agreement.
Law Recently Enacted:
On May 20, 2009, President Obama signed into law “Helping Families Save Their Homes
Act 2009.” One small provision of this of this law was also aimed at protecting tenants at foreclosure.
This provision was designed to provide new protection to tenants of residential properties being foreclosed by any party including
mortgagees, homeowners or condominium associations.
In summary, the Act provides that tenants of residential property subject to foreclosure
must be given at least 90 days notice before they are required to vacate the property. If a bonafide lease exists prior
to foreclosure, the tenant may continue to occupy the property through the end of the lease. However, this lease may
be shortened to 90 days when the property is sold in the foreclosure action to a third party who intends to occupy the property
as a primary residence. In any event, the tenant still must be provided 90 days written notice.
