BREEDING AGREEMENT FOR SHADRACK TRITON GIMCRACK (AMHA #24866)

Shadrack Triton Gimcrack is owned by Sonya & Stan Sokolow, hereinafter called stallion owner.

_____________________ is owned by ___________________, hereinafter called mare owner.

Mare is registered in ________________________ registry with registry # ________________.

By the terms of this agreement:

1. Stallion will be bred to mare during the ____________________________ breeding season, until mare is confirmed to be in foal by stallion owners and/or their veterinary services. Stud fee will be $______________, payable in advance of breeding.

2. Handling of stallion and mare will be at the discretion of stallion owners. All reasonable efforts will be made to provide mare with proper care to ensure her health and safety. However, stallion owners, or their representatives, shall not be held liable for any loss, sickness, disease or injury during the time the mare is in custody of the stallion owners. The mare owner understands that stallion owners do not carry any of the horses that are in their possession for breeding on any liability, accidental injury, theft or equine mortality insurance. All risk to the mare is to be borne by the mare owner.

3. Stallion owners shall provide a certificate of service from the American Morgan Horse Association (AMHA), or if applicable, from the American Part Blooded Horse Registry (Half-Morgan Resister). Both stallion and mare owners agree to provide all signatures required to enable registration of the foal in the appropriate horse registry.

4. The ___________ owner agrees to accept responsibility for all veterinary expenses directly due to breeding, pregnancy, and foaling, as deemed necessary by the stallion owners and their veterinary services. This shall include any and all procedures necessary to breed the mare and any routine or emergency services declared by a veterinarian to be due to pregnancy or nursing. Any other veterinary expenses will be borne by _____________ owner.

5. The ___________ owner agrees to accept responsibility for all farrier expenses as deemed necessary by the stallion owners and their veterinary services.

6. The ___________ owner agrees to accept responsibility for all board expenses as deemed necessary by the stallion owners and their veterinary services. Mare will be boarded at ________

owner's property until confirmed to be pregnant or until breeding attempt is discontinued for the breeding season. Pregnant mare will be boarded by the ___________ owner until foal is weaned.

After breeding is discontinued without pregnancy, mare will be boarded at _________ owner's property until next breeding season. During pregnancy, owner with custody of the mare shall be entitled to use mare for normal equestrian activities.

7. The ___________ owner shall provide proof of negative uterine culture taken within the last 45 days prior to the desired breeding date, as well as proof of current vaccinations deemed necessary by stallion owner and their veterinary services..

8. Mare must be halter broke, able to be hobbled and hind shoes must be removed. If deemed appropriate in joint agreement by stallion and mare owner, mare will be habituated to breeding hobbles for one week prior to pasture breeding, and hobbles will be used during such breeding.

9. In the event that it is necessary for stallion owner to hire an attorney to enforce the terms of this agreement, or to defend against an action brought by the mare owner, whether or not it results in a lawsuit filed in a court of competent jurisdiction, stallion owner shall be entitled to reasonable attorney fees and costs. In the event it is necessary to resort to a court of law in order to enforce the terms of this agreement or to defend against an action against the mare owner, it is agreed between the parties that the venue of said court action shall be exclusively limited to the County of Santa Cruz, State of California.

10. If for any reason a serviced mare does not produce a "live foal" defined as a foal standing and nursing without assistance for 24 hours after birth, owner of stallion and mare may agree to repeat this breeding attempt with the same stallion and mare (or a substitute mare, upon mutual agreement between the stallion and mare owners), during the balance of the agreed-upon breeding season and for the following calendar year, if necessary, with rebreeding dates to be at the mutual convenience of stallion and mare owners. All other original conditions of this agreement would continue for an extended period and for an acceptable substitute mare.

11. If cool semen transport is used for insemination, _____________ owner will be responsible for all expenses involved in getting semen to site within 48 hours of collection. Palpation and insemination expenses will be the responsibility of ______________ owner.

12. If live cover is to be used for insemination, mare will be brought to stallion owner's residence at _______________ owner's expense, and mare will be returned to mare owner's residence at ______________ owner's expense. Mare care will be $___________ per day. Mare + foal care will be $___________ per day

Any other conditions stipulated by stallion and mare owners shall be noted in an addendum.
