The following are proposed
orders and other material to help you through the process of
filing a Petition to Approve a Minor's Contract, a
Petition for an Early Release of Coogan Funds, or an
Application to Terminate a Minor's Coogan Account pursuant to
California Family Code §
6750 et seq. or California Labor Code §
Orders For Petitions to Approve Contracts
In addition to what is listed in the order, you will need to attach a Family Law Case Cover Sheet to the petition (check the box for "Approval of Minor's Contract"). For the safety of the minors, please do not disclose the residence address of a minor in any document filed with the court. Petitions must be filed in the Central District at the Family Law Filing Window in Room 426 and accompanied by a proposed order, a copy of the petition and proposed order for your records, a self-addressed envelope with postage paid, and $435.00 filing fee.
Order Approving Minor's Contract in Arts, Entertainment, and Professional Sports [Family Code § 6750 et seq.; Local Rule 14.8 ]. Use this order when the minor is the contracting party. Note that the caption of the proposed order reflects that the minor is appearing by and through a guardian ad litem. The petition should reflect the parties in the same way as the proposed order, and the minor may appear through only one guardian ad litem (although the proposed order may name more than one trustee of the blocked account). The first part of the proposed order is also a checklist of the documents required to be filed in order to obtain court approval of the contract. Note that the requirements of Family Code 6751(a) are jurisdictional, i.e., the contract may only be approved by the superior court of the county in which the minor resides or is employed or in which any party to the contract has its principal office in California for the transaction of business. Parents of a minor residing outside California must provide a quitclaim as indicated in this order.
Order Approving Minor's Contract (loan out). Same order as above, but use this one when the minor's loan out corporation is the contracting party. Parents of a minor residing outside California must provide a quitclaim as indicated in this order.
Order Approving Minor's Talent Agency Contract [Labor Code § 1700.37]. The first part of the order is also a checklist of the documents required to be filed in order to obtain court approval of the contract. Note that the requirements of Labor Code 1700.37 are jurisdictional, i.e., the contract may only be approved by the superior court of the county where the minor resides or is employed.
Orders to Amend Prior Court Orders
Amendment to Prior Order Approving Minor's Contract . Use this order if your previous order did not provide for transferring blocked funds to other accounts and financial institutions, including brokerage companies, and for purchasing United States Government securities, including treasury bonds, certificates of deposit, money market instruments and money market accounts.
Amendment to Prior Order (loan out). Same order as above, but use this one when the minor's loan out corporation was the contracting party.
Material to Unblock Funds
You will need Adobe Acrobat Reader to view and print the forms from the web. If you do not have Adobe Acrobat Reader, you may download the application for free from Adobe's Web Site. For the safety of the minors, please black out the street address where the minor resides in any document filed with the court.
For Release Of Coogan Funds Before Minor Turns 18:Instructions and Petition For Withdrawal Of Funds From Blocked Account: Use this form to request a release of funds from a Coogan Account before the minor attains the age of 18 or becomes emancipated. Note that you must click on each of the links above to obtain both documents. You may also need a Family Law Case Cover Sheet, Declaration Form, Income and Expense Forms, and Order For Withdrawal Of Funds From Blocked Account. For the safety of the minor, please black out the address of the minor on any documents you submit to the court (e.g., bank statement, copy of driver's license).
For Release Of Coogan Funds After Minor Turns 18:Instructions and Application To Terminate Minor's Blocked Account: For earnings blocked pursuant to a contract entered into before January 1, 2000, use this application to terminate the account if the order did not provide for a release of funds upon the minor's eighteenth birthday. Note that you must click on each of the links above to obtain both documents. For the safety of the minor, please black out the address of the minor on any documents you submit to the court (e.g., bank statement, copy of driver's license).
For earnings blocked pursuant to a contract entered into on or after January 1, 2000, no court order is required to terminate the blocked account. "Upon reaching the age of 18 years, the beneficiary may withdraw the funds on deposit in trust only after providing a certified copy of the beneficiary's birth certificate to the financial institution where the trust is located." (Family Code Section 6753(b).)
