Abner Mays to David Liles

 

THIS INDENTURE made this twenty fifth Day of August in the year of our Lord one thousand seven hundred and eighty seven BETWEEN Abner Mays of the State of South Carolina and County of Edgefield of the one part and David Liles planter of the other part. WITNESSETH that the said Abner Mays for and in consideration of the sum of ten pounds lawful current money of the State aforesaid to him in hand well and truly paid by the said David Liles at and before the sealing and delivery of these Presents the receipt whereof he the said Abner Mays doth hereby acknowledge HATH bargained sold and by these Presents Doth bargain and sell unto the said David Liles All that Tract or parcel of land containing ninety acres be the same more or less lying and being in the State and County aforesaid on the Halfway Swamp Waters of Salda River and Bounded as followeth begin[n]ing at a Pine on Holloways and runnning South 27:00 on vacant land to White Oak corner thence North 21 to a corner Pine thence North 15 E 17.00 to Black Oak corner thence NE W 23.50 to a Box [?] Oak corner reference being had to a Plat thereof may more fully appear with all and singular the Houses buildings Orchards Gardens ways passages liberties and priviledges profits hereditaments rights members and appurtenances whatsoever thereunto belonging or in any wise appertaining and the reversion and reversions remainder and remainders rents issues and profits thereof and every part and parcel thereof TO HAVE AND TO HOLD the said tract or parcel of land containing Ninety acres more or less TOGETHER all and singular the appurtenances thereto belonging unto the said David Liles his heirs Executors Administrators and assigns from the Day next before the date of these presents for and during the term one whole year from thence next ensuing and fully to be compleated and ended yielding and paying thereof unto the said Abner Mays the rent of one Pepper Corn on the last day of the said term the same shall be lawfully demanded to the intent and purpose that by virtue of these Presents and by force of the Staute for transferring uses into possession he the said David Liles may be in actual possession of all and singular the Premises above mentioned with every of the appurtenances thereunto belonging and thereby be the better to have take and receive the reversion and Inheritance there of which is intended to him his heirs granted and released by the said Abner Mays by another Indenture intended to be made and dated the day next after the date hereof IN WITNESS whereof he the said Abner Mays hath hereunto set his hand and affixed his Seal the day & date first above mentioned

Know all men by these presents that I Olley Man Dodgen of Edgefield County and state aforesaid Planter for and inconsideration of the sum of three hundred Dollars to me paid by David Liles of Edgefield County and state aforesaid Planter have Granted Bargained sold and Released and by these Presents do Grant bargain sell and Release unto the said David Liles all that part or parcel of land containing two hundred and Sixty two acres let the same be more or less situate in Edgefield County on the waters of big creek of saluda river bounded to the SW and NE & NW on land belonging to the Estate of William Wilson S.E. on land held by Samuel Mays NE on part of said tract held by William Ward SW on Gideon Christon the same being part of two tracts originally granted to John Chiney the second day of January 1786 and Conveyed to Wm Deen and conveyed by William Deen to the said Olley Man Dodgen the other granted to Joel Pardue the 4th day of March 1793 and conveyed by Joel Pardue to the said Olley Man Dodgen TOGETHER with all and singular the Rights members hereditaments and appurtinances to the aid premises belonging or in any wise incident or appertaining TO HAVE AND TO HOLD all and Singular the premises before mentioned unto the said David Liles his heirs and assigns forever and I do hereby bind myself my heirs Executors and Administrators to Warrant and forever defend all and singular the said premises unto the said David Liles his heirs and Assigns Against myself my heirs and Against all and Every person Whatsoever Lawfully Claiming the same or any part thereof WITNESS my hand andSeal this Sixteenth day of March in the yearof our Lord one Thousand seven hundred and Ninety Eight and inthe twenty second year of the Independance of the United States of America__ SSIGNED SEALED AND DELIVERED

Know all men by these presents that I William Moon Joshua Deen & Tabatha Deen wife of Joshua Deen of the state and county aforesaid for and in consideration of the sum of seventy five Pounds Sterling to us in hand paid by David Liles of the county and state aforesaid have granted Bargained sold & released and by these Presents to Grant Bargain sell & release unto the said David Liles all that Plantation or Tract of land situate lying and being in the county & state aforesaid on Big Creek waters of Saluda River Containing Two hundred and Eighty acres be the same more or less Bounded to the East on Land held by the heirs of Isaac Crowther [?] all other sides by Vacant Land at the time of the survey and was originally Granted to Rowling Courney on the 25 Day of January 1785 and conveyed by Rowling Courtney to Joshua Deen by a lease & release _____ and conveyed by Joshua Deen by lease and release to William Moon on the 14th Day of March 1798 Together with all and singular the rights members and appurtinances to the said premises Belonging or in any wise incident or appertaining thereto TO HAVE AND TO HOLD all and singular the premises Before mentioned unto the said David Liles his heirs and assigns forever and we do hereby Bind ourselves our heirs Executors and Administrators to warrant and Defend all and singular the same premises unto the said David Liles his heirs and assigns against ourselves our heirs and against Every person whomsoever Lawfully Claiming or to Claim the same or any part thereof WITNESS our hands and seals this the Eleventh Day of December in the year of our Lord one thousand seven hundred and ninety nine and in the Twenty Third year of the Independance of the United States of America. Know all men by these presents that I David Liles of the district of Abbeville in the state aforesaid in consideration of the sum of twenty one pounds ten shillings sterling to me paid by Joseph Reatherford of the place aforesaid have granted bargained sold and released and by these presents do grant bargain sell and release unto the said Joseph Reatherford all that tract of land [illegible] seventy four acres situate in the district of Edgefield and state aforesaid upon [B]ig [C]reek a branch of [L]ittle [S]aluda [R]iver originally granted to Alley man Dodgin and convayed from said Dodgin to the above David Liles Bounded on the North by land held by Gideon Christian on the South by lands held by Wm Wilson deceased on the west by land held by Thomas Turk Having such forms [and] marks as are represented by the plat annexed to the original Grant which was Grantd Joel Perdew from under the seal of the state of the fourth day of March Anno Dom. Memorandum that on the sixth day of aug. one of the subscribing witnesses to the within came before me and upon being duly sworn saith that he was personally present and did witness the within David Liles sign seal and as his act and deed deliver and acknowledge the within deed of conveyance to and for the use and purpose therein set forth and that with himself [the end is missing].

The following two deeds concerning the sale of David Lyles' land after he had died in 1839 or very early 1840 were one of our best discoveries when we delved into the records in Pickens and Oconee Counties, S.C., this June 1999. From a brief abstract given to us by one of our correspondents, we supposed that the deeds still existed showing that Joseph Lyles acting as administrator or executor sold David Lyles' land. But we were surprised to find that our William A. Lyles, collaborating with Joseph Lyles, witnessed both deeds.

Know all men by these presents that I, Reuben Gilbert of the State & District aforesaid for and in consideration of the sum of one hundred & fifty dollars the receipt of which I do hereby acknowledge. Have bargained, sold and conveyed [illegible] unto James H. Dendy. All that plantation and tract of land situate in Pickens District on Chauga Creek waters of Tugaloo River and containing one hundred acres more less formerly owned by Aaron Mills bounded by the lands of Robert Hackett and a small tract formerly owned by David Liles and another small tract formerly owned by Humphrey Lindsay. To have and to hold all & singular the premises above mentioned unto the said Jas. H. Dendy, his heirs and assigns forever. And I do hereby bind myself, my heirs and assigns to warrant and forever defend the said tract of land against myself my heirsand against all persons whomsoever lawfully claiming or to claim the same or any part thereof. In witness whereof I have hereunto set my hand and seal this 13th day of January, Anno Domini one thousand eight hundred and forty, the sixty fourth year of American Independence.

Know all men by these presents that I, Joseph Liles of the State and District aforesaid for and in consideration of the sum of fifty four dollars the receipt of which I do acknowledge. Have bargained, sold, released and conveyed unto James H. Dendy all that plantation or tract of land situate in Pickens District on Chauga Creek waters of Tugaloo River and containing one hundred acres more or less formerly owned by David Liles deceased, bounded by lands [of] the Mill tract and the tract formerly belonging to Gilson Oliver deceased, and adjoining the Lindsay tract of 100 acres. To have and to hold all and singular the premises above named unto the said James H. [Dendy], his heirs & assigns forever. And I do bind myself, my heirs, executors, admrs. & assigns to warrant and forever defend the lands aforesaid. Together with all and singular the rights, members, herediments & appurtenances to the said premisesbelonging against myself & my heirs, and against all persons whomsoever lawfully claiming or to claim the same or any part thereof. In witness whereof I have hereunto set my hand and affixed my seal this 13th day of January in the year of our Lord one thousand eight hundred and forty 1840 and sixty fourth year of American Independence.
