to
the stallion,_______________________________ standing at Bagley Performance
Horses,
A
booking fee of $250 is required at the time this contract is submitted. The booking fee will not be refunded under
any condition.
The
remainder of the breeding fee will be due when the mare is certified pregnant
and before the mare leaves. Upon receipt
of full payment for all services, Bagley Performance Horses will issue a
breeder’s certificate. Mare care for dry
mares is $_____/day and $___/day for wet mares.
After
arrival, the mare will be checked for normal breeding conditions, treated for
any disease or injuries and dewormed if necessary. All mare MUST have: 1) a current negative Coggins test (within
the last 6 mo), 2)a current health certificate (within the last 10 days), and
3) current vaccination for influenza. It
is strongly advised that mare be vaccinated for strangles and

copy of the registration certificate must be provided to Bagley Performances
when the mare is delivered.
Mares
that are not halter broken or that are otherwise difficult to handle or manage
will not be accepted.
Judgments
and implementation of care and management of the mare and/or foal will be under
the complete supervision and discretion of Bagley Performance Horses. Bagley Performance Horses will not be
responsible for any accident, sickness or death of mares or foals. Likewise, the mare owner will not be
responsible for any accident or injury to any horses or personnel which may be
caused by the mare identified herein.
All
breeding will be done by artificial insemination except where prohibited by
breed association rules.
1)
Bagley Performances Horses guarantees a live foal if the mare remains on the
Dimmitt premises until certified 30 days pregnant by a veterinarian. If the mare is removed before being certified
pregnant, all bills will be due and the live foal guarantee will not be
granted. A live foal guarantee will
apply only if Bagley Performance Horses is notified of death of the foal within
seven days. This notice must be
accompanied by a written statement from a licensed veterinarian verifying that
the foal did not stand and nurse.
2) If the mare proves not to be in foal in the
year bred, or loses her foal as stated above, the mare owner may rebreed the
same mare the next breeding season or breed another mare if the above named mare
is certified unfit for breeding in the next breeding season. In either case, a new Stallion Service
Contract will be executed void of any stallion service fees for mating to the
same stallion or another stallion standing at not more than the original
stallion service fee. If the stallion
dies or becomes unfit or unavailable for service and the return breeding
privilege is exercised to another stallion standing at a higher fee, the mare
owner will pay the additional difference in stallion service fees. In all cases, the return breeding privilege
MUST be exercised in the next immediate breeding season or the contract becomes
void.
In
the case of nonfoaling (dry) mares, should mare owner fail to deliver said mare
before May 15 of the current year to Bagley Performance Horses for the purpose
of breeding, then this contract shall become null and void. All breeding will be terminated July 1.
Should
the above named stallion die or become unfit for service, or if the mare die or
become unfit to breed before July 1 of this year, then this contract shall
become null and void.
The
mare will not be released from Bagley Performance Horses to anyone without
written authorization from the mare owner and until all bills are paid in full.
The
contract shall not be assigned or transferred by the mare owner.
The
contract is not valid unless completed in full and signed.
