John Perry Barlow is right on the point when he states that Intellectual property law cannot be patched, retrofitted or expanded to contain digitized expression any more than real estate law might be revised to cover the allocation of broadcasting spectrum.Considerations of fair use in the area of citations include:

2. The nature of the work
3. The amount and substantiality of the portion used in relation to the work as a whole
4. The effect of use on the market for value.
