Looking out for the little guy, Boomer style. Last week's signing into law of new class-action lawsuit legislation pitted Democrats against Republicans in an argument over the propriety of multi-million dollar verdicts against corporations and the tricks of the trade used by lawyers to achieve them.
A typical point from the Republican side, made by Roy Blunt in the linked article, is that state judges "routinely approve settlements in which the lawyers receive large fees and the class members receive virtually nothing." Democrat Ed Markey counters that this law is "the final payback to the tobacco industry, to the asbestos industry, to the oil industry, to the chemical industry at the expense of ordinary families who need to be able go to court to protect their loved ones when their health has been compromised." There's truth to both sides' point of view, and what's really going on here is that a Boomer dominated Congress is obsessed with the morality of corporate America.
Republicans and Democrats alike agree that businesses and lawyers should do the morally correct thing, though they don't agree on exactly what that is. President Bush enjoys a majority in support of his point of view. Look for more of the same kind of legislation in the years to come.
