  Imitation Firearms [EPCC]; Prohibits the sale of imitation firearms
  except for certain purposes. Provides that a person who sales, or offers
  for sale, an imitation firearm in this state commits a first degree
  misdemeanor and that any subsequent violation is a third degree felony.
  Defines "imitation firearm" as any toy gun, replica of a firearm,
  air-soft gun that fires nonmetallic projectiles, or other specified
  device, etc.  EFFECTIVE DATE: 10/01/2008.

  fraudulent identification by using the identity of a victim of identity

  order for the return of a confiscated firearm taken under a search
  warrant or without a search warrant upon a breach of the peace. Provides
  that a petition be filed with the court for the return of the firearm.
  Requires the court to order the return only upon evidence that the
  person does not pose a risk of harm and has the capacity to contract or
  manage his or her affairs, etc.  EFFECTIVE DATE: Upon becoming law.
