Scenario 1: A U.S. subcontractor employs
a Mexican national engineer to help manufacture sophisticated electronic telecommunications equipment for end
use in commercial and defense aircraft. The company failed to conduct due diligence inquiries on the individual
and failed to request export approvals before granting him access to equipment, technical data, and services controlled under
the Department of Commerce's (DoC) Export Administration Regulations (EAR) and the Department of State's (DoS) International
Traffic in Arms Regulations (ITAR).
Scenario 2: A U.S. subcontractor manufactured and exported without
a license integrated circuits (ICs) to an overseas buyer residing in a country in the Middle East. The ICs were
specifically designed for end use in night vision equipment by the U.S. Army. The U.S. company is not registered
with the DoS Directorate of Defense Trade Controls (DDTC).
Scenario 3: A marketeer in a hurry to depart on a business
trip pockets a missile pressure gauge from the company's manufacturing floor to hand-carry to Canada as a sample for
marketing presentations to potential buyers. He has no export approval and is stopped by U.S. Customs.
