Will of Mary Bickham

Mary Bickham's will was dated 8 December 1671, and proved 29 February 1672, at St. Marys le Strand in the city of Westminster.  The administrators of the will were her brother Richard Bickham and her brother-in-law Alexander Atkins.

In the Name of God Amen; The eighth day of December in the three and twentieth year of the Reign of our Sovereign Lord Charles the Second by the grant of God of England Scotland France and Ireland King Defender of the Faith [Latin phrase] One thousand six hundred seaventy one I Mary Bickham of Washford, within the Parish of Old-Cleave In the Countie of Sommerset widdowe being sick in bodie, but of good and perfect mind and momorie Thanks be to Almightie God, And calling to remembrance the incertaine Estate of this transitory life, and that all Flesh must yield unto Death when it shall please God to call, doe make constitute ordayne declare and publish this my last Will and Testament in manner and forme following, Revoking and anulling by these Presente all and every Testament and Testaments Will and Wills whatsoever heretofore by mee made and declared either by word of mouth or by writing, and that this shall be taken only for my last Will and Testement and none other; And first being penitent and sorrie from the bottom of my heart for my Sinns past, most humblie desiring forgiveness for the same, I give and commit my Soule unto Allmighty God my Creator in whome and by the merits of Jesus Christ my Redeemer I trust and beleeve assuredly to be Saved and to trust full confession and forgiveness of all my Sinns, And that my soul with my bodie at the yond call day or Resurrection shall rise againe with Joy and through the merits of Christ's death and passion possess and inherit the Kingdom of Heaven prepared for his Elect and chosen; And my Bodie to be decently buryed in such Place where it shall please my Executors hereafter named in this my last Will and Testament to appoint; And nowe for the following of my Temporall Estate and such Goods Chattells and Credits as it hath pleased God farr above my Deserts to bestow upon mee, I doe order give and dispose the same in manner and forme following (that is to say) First I will that those Debts and duties as I owe in right or conscience to any manner of person or persons whatsoever, shall be well and truly contented and payd by my Executors hereafter named within some convenient time after my decease; Item I give and bequeath to the poore of the Parish of Bridgewater in the said Countie of Sommerset the Summe of three Pounds; Item I give and bequeath to the Poore of the Parish of Old-cleave aforesaid the Summe of three Pounds; And I give the Summe of fortie shillings more to be distributed at the descretion of my Executors betweene the Said Parishes; Item I give unto my Sonne of Hugh Bickham the summe of five hundred Pounds, to be payd unto him when he shall attayne unto the Age of one and twentie years, And I also give twentie pounds more unto my said Sonne Hugh, to be paid unto him upon the deliverie of such Goods as are hereafter mentioned and by mee giveen unto my daughter Mary Bickham, Item I give and bequeath unto my said sonne Hugh all the Cloathing-Tools and other materialls belonging to the Cloathing-Trade with a Clocke Chest and Desk and Silver Tankard one Bedd bedstead and all things thereunto belonging, and six silver Spoons and a Chest particularly devised unto my said Sonne Hugh in and by his Father's last Will and Testamt; Item I give unto my daughter Mary Bickham the Summe of five hundred and twentie pounds to be paid unto her when she shall attayne unto the Age of One and twentie years, Which said Trusts and Bequests I doe hereby declare to be in full Satisfaction of their several Legacies of five hundred pounds apeece given them by the last Will and Testament of Aldred Bickham their father deceased; And my Will farther is, that my said Sonne and daughter be brodupp educated and mainteyned by my Executors hereafter named with the interest and profits of their said Portions given and bequested unto them, by this, my last Will and Testament, untill the tyme of Payment of the Trusts and bequests as aforesaid; Item I give and bequeath unto my said daughter Mary Bickham One Silver Cupp One Silver dish foure silver Spoons one Silver Bole two Feather beds and feather Bolsters one Rugg two Blankets foure feather Pillows one paire of wrought Curtaines with fringe and all things to them belonging, two paire of fine Sheets and foure holland pillowes Drawers One Sute of Diaper one Sute of holland One Spruce-Chest, and all my best wearing Apparell; And the rest of my household stuffe within doores as Bedds bolsters Pewter and bedsteads and such like I give unto my said Sonne Hugh; Item I give and bequeath o my Sister Katherine Bickham the summe of ten Pounds in Gold; Item I give and bequeath unto my Aunt Watts of the Cittie of Bristoll the Summe of five Pounds; Item I give and bequeath unto my Brothers William Bickham and Richard Bickham and my Sister Margaret Atkins unto each of them one Peice of Gold of the value of twentie shillings; Item my Will is that all my legacies herein and hereby given and bequeathed Debts payd and funerall Expenses first discharged, if then there happen to remaine any overplus of the said personall estate, That then it be disposed of to either of both of them my Said Sonne and Daughter in such manner and according to such proportion as to my Executors hereafter named shall seem meet and convenient; And in Case my Estate shall happen to fall short to pay and satisfie my Trusts and bequests aforesaid, That then the losse that shall fall-out thereon, my will is, that it be equallie borne by my said Sonne and Daughter by even and equall Portions out of their Trusts and bequests given as aforesaid; Also my will is, that if any losses doth fortune to rise by bad debts or otherwise, and whatsoever Expenses and charges my said Executors hereafter named shall be at in either recoverie of any bad Debts or in the Execution of their Executorshipp, my will is, that my Executors shall deduct it out of my said estate and allowe and pay them selves before the Payment of any of the aforesaid legacies soe given by me as aforesaid; And in case it shall happen that my said Sonne Hugh Bickham shall fortune to dye before hee shall attayne unto the Age of one and twentie years as aforesaid, That then my will is, that the moitie of his part so given unto him as aforesaid shall go to and remayne to my said Daughter Mary, and the other moitie to be disposed of at the descretion of my Executors hereafter named or any two of them or by the Survivor of any of them to be equally divided amongst my Brothers and Sisters and their children lawfully begotten of their bodies which shall be then living; And also if my said daughter Mary shall happen to dye before she shall attayne unto the Age of one and twentie years as aforesaid, That then my will is that her Mortie of her part soe given unto her as aforesaid, shall be equallie divided amongst my Brother and Sisters and their Children lawfully begotten of their Bodies which shall be then living; And the other moitie of her part soe given unto her as aforesaid, to goe and remayne unto my said Sonne Hugh to be imployed for him or for his use as by the discretion of my Executors hereafter named shall deeme fit and convenient soe as hee shall conduct himself orderly and live soberly and not otherwise; Item my will farther is that in Case both my said Sonne and daughter shall fortune to dye before they attayne unto their Severall Ages of One and twentie years as aforesaid, That then I give and bequeath their said Portions in manner and form following; First I give and bequeath unto my Brother Richard Bickham of the Cittie of Bristoll One five hundred and twentie Pounds to be equallie divided amongst his children which shall be then living, And the other five hundred and twentie pounds I give and bequeath unto my Sister Margaret Atkins, nowe wife of Alexander Atkins of Bridgewater to be equally divided amongst all her children had by both her husbands (that is to say) Francis Tucker her former husband, and the said Alexander Atkins her nowe husband, which shall be then living; Item I give and bequeath unto my Brother Richard Bickham, Alexander Atkins of Bridgewater aforesaid and Stephen Landslark of Nynehead in the said Countie of Sommerset all the rest of my Goods Chattels and Credits and all my Estate reall and personall whatsoever not before herein and hereby given and bequeathed, who I doe make constitute and appoint to be of this my last Will and Testament my full and sole Executors, desiring them and everie my last Will and Testament;
