Minutes for the Village of Beverly Regular Council Meeting

Held January 12, 2006

 

             The Regular meeting of the Village of Beverly Council was held Thursday January 12, 2006 at 7:00 P.M. with Mayor Jay Arnold presiding. Members, Clem Biedenbach, Dave Price, Stacey Brooks, and Laura Adams answered to roll call. Clerk Larry Kitts, Supervisor of Services Sam Brooker, David (Doc) Lowe of the Fire Department, Sherry Saunders, Art Offenberger, Greg Schott, Katie Miller, Tammy Bates, Bernard Clark, Karla Lewis, Jim Ullman, Claude and Donna Rayner were also present.

            Mayor Jay Arnold led the prayer and pledge.

            Clerk-Treasurer Larry Kitts swore in Mayor Arnold. Mayor Arnold swore in newly elected council members Laura Adams and Clem Biedenbach. Price moved to appoint Clem Biedenbach Council President, Adams seconded the motion and all answered yes to roll call (4-0); Arnold then swore in Biedenbach.

            Minutes of the December 8, 2005 regular meeting and December 28, 2005 Special Meeting were presented and approved.

            Mayor Arnold recognized the guests and asked for them to present any business they might have for council.

            Miss Miller stated she had no entrance to her home for the purpose of unloading groceries etc. with the new street signs installed. Council stated there would be no problem with unloading from the street and then moving the vehicle off the street when done unloading.

            Mr. Rayner stated he thought the sign should be moved farther down the street. Arnold suggested the street committee evaluate the sign spacing and report at committee meetings.

            Mr. Offenberger stated he would have no objections to deed restrictions on his proposal. Arnold stated that solicitor Webster needed to be in attendance when this issue is discussed further.

             MAYOR’S REPORT: Arnold Suggested moving the Council Meeting to the 2nd Wednesday of the Month Biedenbach moved to have the February Regular Meeting the 8th of February have the clerk prepare and ordinance changing the meeting date, Brooks seconded the motion and all answered yes to roll call.

 

CLERK’S REPORT: Kitts reported the Fire Contract Ordinances needed to be approved and the Dameyon Shipley had stated the grant had been approved for the swimming pool.

 

COMMITTEE REPORTS:

 

LANDS, BUILDINGS, PARKS AND RECREATION: Price requested using the Village Building to store some of the Christmas decorations. Approval was given by council. Discussion was held regarding a complaint by Aaron Courtney about the trash service in Beverly. Arnold stated this issue would have to be resolved by Kevin Offenberger and Courtney. Discussion was also held regarding Richard McNabb’s request to park the Lion’s Club Roadside Coffee Camper at the garage. This issue would also be discussed at committee meetings in February.

 

SWIMMING POOL: Adams reported the YMCA would furnish instruction for underprivileged children if a lifeguard is furnished on the 30th of June.

 

STREETS, ALLEYS, & SIDEWALKS: Permission was given to close the alleys adjacent to the American Legion building during renovation of this building.

 

POLICE, FIRE & SAFETY: Biedenbach moved to pay $160000 on the Firehouse note and $5000 every month for the remainder of the year, Adams seconded the motion and all answered yes to roll call (4-0).

 

SUPERVISOR OF VILLAGE SERVICES: Brooker reported he had purchased the liquid salt for the fire department parking area; Most of the cross walks are painted, and Doug Thieman referred the retiming of the Center and Fifth St. stoplight to Tom Camden and he may need a letter from council for this request.

 

ORDINANCE, FINANCE AND INSURANCE: Brooks moved to suspend the rules; Price seconded the motion, and all answered yes to roll call (4-0). Brooks moved to read ordinance 06-2 SPECIAL PURPOSE FLOOD DAMAGE REDUCTION [ORDINANCE 06-2 – VILLAGE OF BEVERLY] [BEVERLY], OHIO by title only. Adams seconded the motion and all answered yes to roll call (4-0). Brooks moved to approve ordinance 06-2. Adams seconded the motion and all answered yes to roll call (4-0).

            Brooks moved to read ordinance 06-3 AN EMERGENCY ORDINANCE TO AUTHORIZE THE CLERK AND MAYOR TO ENTER INTO AN AGREEMENT WITH WATERFORD TOWNSHIP TO PROVIDE FIRE PROTECTION FOR WATERFORD TOWNSHIP by title only. Price seconded the motion and all answered yes to roll call (4-0). Brooks moved to approve ordinance 06-3. Adams seconded the motion and all answered yes to roll call (4-0).

            Brooks moved to read ordinance 06-4 AN EMERGENCY ORDINANCE TO AUTHORIZE THE CLERK AND MAYOR TO ENTER INTO AN AGREEMENT WITH JACKSON TOWNSHIP TO PROVIDE FIRE PROTECTION FOR THE RESIDENTS WHO LIVE ON THE “984” BEVERLY TELEPHONE EXCHANGE IN JACKSON TOWNSHIP by title only. Price seconded the motion and all answered yes to roll call (4-0). Brooks moved to approve ordinance 06-4. Price seconded the motion and all answered yes to roll call (4-0).

            Board of Public Affairs Representatives and Karla Lewis were present to voice concern that Council would not honor the contract. After extensive heated discussion the matter was tabled until more input from the solicitor could be obtained. Biedenbach moved to have Karla work from 7:30 A.M. until 4:00 P.M. Motion failed for lack of a second.

Committee meetings were scheduled for February 2, 2006 at 7:00 P.M.
