Q. Do I need to test all of my current employees?

A. No. The most common misconception about the Drug Free Workplace is that all employees will need to be tested. This is not the case !!! The only required tests for most companies under the Worker's Comp guidelines are Pre-employment and Reasonable suspicion. You do not need to test current employees except for reasonable suspicion.  Top

Q. Do I have to wait for the drug test report before starting a job applicant working?

A. No. You may start employees working immediately pending test results. By definition "Job applicant means a person who has applied for a position with an employer and has been offered employment conditioned upon successfully passing a drug test, and may have begun work pending the results of the drug test." (Section 440.102 j Florida Statutes)  Top

Q. How long does it take to get the test results?

A. Most negative test results are reported within 24 hours of the test (next business day). Occasionally there will be a delay in reporting due to chain of custody issues with the collection site or laboratory so you cannot assume that a test is positive just because the reporting is delayed.  Top

Q. What is considered Reasonable suspicion for drug testing?

A. Belief that an employee is using or has used drugs in violation of the company's Drug Free Workplace policy. (Alcohol is considered a drug for this type of testing.)
This may include :

    • Observable phenomena (direct observation of use)
    • Abnormal conduct or erratic behavior
    • Report of drug use by a reliable and credible source
    • Having caused, contributed to, or been involved in an accident at work
    • Evidence that an employee has used, or sold drugs while at work or while operating company equipment.

Q. How often do I need to test my employees?

A. Only one time (at time of hire), unless there is reasonable suspicion to test them again or at the time of an annual physical exam if you require it for the job.  Top
