Private Information Contract

My personal information (including, but not limited to, my name, postal address, telephone number, and e-mail address) was NOT provided to you BY ME. It is, therefore, not to be used for ANY purpose (including, but not limited to, commercial purposes and marketing promotions).

This personal information is not to be shared, sold, distributed, or disseminated to any other party (including, but not limited to, franchisees, affiliates, partners, and subsidiaries) in any way, shape, or form for any reason short of a court order.

As this is personal and private information regarding myself, you agree that ownership of this information shall be retained by me. Accordingly, you agree to be responsible and liable for any use of this information that is not in accordance with this contract. This shall include any and all costs that I must incur deriving from said misuse of my private information. Should this information be used for any purpose not in accordance with this contract, you agree to be liable and billable for said misuse at a rate of $300 for each unsolicited communication I receive deriving from said misuse, including messages sent by parties who received my personal information from you.

You agree that this contract supersedes your privacy policy.

Acceptance and/or use of this information shall constitute acceptance of and agreement with this contract. Allowing my private information to be distributed to any other party, whether by accident or design, shall constitute use of said information.

This policy applies to you regardless of what name you choose to hide behind.

Should you not accept this contract, you are required to inform me, in writing, of your non-acceptance of this contract and refund all costs associated with any purchase I may have made of your product, including all shipping charges, both for shipping your product to me and for me to ship said product back to you. You must then delete all copies of and references to my private information.

Should any clause in this contract be deemed unenforceable for any reason, all other clauses shall remain in force.
